🔒 TRIPSHED TERMS OF SERVICE, PRIVACY POLICY & FEES

This document (“Terms”) constitutes a legally binding agreement between you (“Customer”, “you”, or “your”) and TripShed (“TripShed”, “we”, “our”, or “us”) governing your access to and use of our website, services, and any related applications or platforms.
By accessing, browsing, submitting a claim, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including all policies referenced herein.
If you do not agree with any part of these Terms, you must discontinue use of our services immediately.
1. DEFINITIONS
For these Terms, the following definitions shall apply:

“Claim” refers to any request, demand, or assertion made by or on behalf of a Customer seeking compensation, reimbursement, refund, or any form of redress from an airline or responsible party in relation to a flight disruption.

“Compensation” means any monetary payment, settlement, reimbursement, goodwill gesture, voucher, or other benefit granted by an airline or third party in connection with a Claim.

“Services” refers to all services provided by TripShed, including but not limited to eligibility assessment, claim preparation, submission, processing, communication, escalation, and support.

“Customer” means any individual who submits a claim or uses TripShed services, including when acting on behalf of other passengers.

“Airline” refers to the carrier responsible for operating the flight associated with the Claim.
-
“Third Parties” refers to any external partners, including legal professionals, service providers, or technical platforms engaged by TripShed.
2. NATURE AND SCOPE OF SERVICES
TripShed provides assistance services designed to help air passengers understand and enforce their rights in relation to travel disruptions, including but not limited to delays, cancellations, denied boarding, and baggage-related issues.
Our services may include:

Assessing eligibility for compensation under applicable regulations

Preparing and submitting claims to airlines
-
Managing ongoing communication with airlines
-
Escalating claims to regulatory bodies or dispute authorities
-
Coordinating with third-party legal professionals where required
TripShed operates as a service provider and intermediary, and not as a law firm. We do not provide legal advice, nor do we establish an attorney-client relationship with customers.
While we use our experience and data-driven processes to maximise the likelihood of success, TripShed does not guarantee the success, outcome, or timing of any claim, as final decisions are made by airlines, regulators, or courts.
3. ELIGIBILITY, REPRESENTATIONS & USER OBLIGATIONS
By using our services, you represent and warrant that:

You are at least the age of legal majority in your jurisdiction

You have the legal capacity to enter into binding agreements

All information submitted is true, accurate, and complete

You are authorised to act on behalf of any additional passengers included in the claim
You further agree that:

You will not submit duplicate claims through other providers
-
You will promptly provide any requested documentation
-
You will not engage in fraudulent, misleading, or abusive conduct
TripShed reserves the right, at its sole discretion, to reject, suspend, or terminate any claim where:

Information provided is inaccurate or incomplete
-
Fraudulent activity is suspected
-
Legal or operational constraints prevent processing
3.1 Customer Cooperation
You agree to cooperate with TripShed and provide all requested documents and information in a timely manner. Failure to do so may result in delays, suspension, or closure of your claim.
4. SERVICE PROCESS AND DISCRETION
Upon submission of a claim, TripShed will conduct an internal assessment to determine eligibility and viability.
Where a claim is deemed suitable, we may proceed with:

Submission to the airline

Follow-up communications
-
Negotiation and settlement discussions
-
Escalation to authorities such as the Canadian Transportation Agency (CTA)

Legal escalation through third-party partners, where appropriate
TripShed retains full discretion in determining:

Whether to pursue or discontinue a claim
-
Whether to accept or reject settlement offers
-
Whether to escalate claims further
Such decisions are based on multiple factors, including applicable laws, airline response patterns, historical outcomes, and operational feasibility.
4.1 AUTHORIZATION TO ACT
By submitting a claim, you authorize TripShed to act on your behalf in relation to the Claim, including:

Communicating with airlines and third parties

Submitting and managing claims
-
Negotiating settlements
-
Escalating claims to relevant authorities
You agree not to appoint another third party or pursue the same claim independently once TripShed has commenced processing.
5. FEES & PAYMENT TERMS
TripShed operates on a transparent, dual-model pricing structure. By selecting a plan, you agree to the applicable fee terms outlined below.
5.1 Commission Plan (Conditional Fee Model)
Under this model:
A nominal upfront fee is charged:

CAD 9.99 for claims with an estimated value under CAD 50
-
CAD 19.99 for claims with an estimated value above CAD 50
In the event of successful recovery of compensation:

A 35% service fee will be deducted from the total compensation amount
In the event no compensation is recovered:
-
No success fee will be charged if the claim is unsuccessful.
This model is designed to minimise upfront financial risk for the customer.
5.2 Upfront Plan (Fixed Fee Model)
Under this model:

A fixed, one-time upfront fee is charged, ranging from CAD 19.99 to CAD 99.99, depending on the estimated claim value
-
No percentage-based deductions apply
-
The customer retains 100% of the compensation received
This model is designed to maximise the customer’s final payout.
5.3 Fee Adjustment Mechanism
All pricing tiers are based on actual compensation recovered, not initial estimates.
Where compensation exceeds the estimated value:

The applicable pricing tier may be adjusted
-
Any difference in fees will be fairly applied
This ensures alignment between pricing and final outcomes.
5.4 Non-Refundable Fees
All upfront fees are non-refundable once claim processing has commenced.
This reflects the allocation of operational resources, including claim evaluation, documentation handling, and processing efforts.
5.5 TripShed Credits Policy
In cases where claims are unsuccessful:

Customers may, at TripShed’s discretion, receive TripShed credits equivalent to the upfront fee.

Credits may be used for future claims for yourself, family, or friends.

Credits do not expire and remain valid for lifetime use
5.6 Direct Payments from Airlines
If compensation is paid directly to you:

You are obligated to notify TripShed without delay
-
If compensation or any form of settlement is received directly from the airline after engaging TripShed, you remain legally obligated to pay the applicable fees. TripShed reserves the right to invoice and recover such fees through appropriate legal or collection measures.
Failure to notify may result in enforcement action.
6. LEGAL ACTION & THIRD-PARTY ENGAGEMENT
Where necessary, TripShed may escalate claims through third-party legal professionals or regulatory channels.

Such escalation is conducted at TripShed’s discretion

TripShed covers associated legal costs
-
No additional legal fees are charged to customers beyond the agreed pricing
No direct legal relationship is established between the customer and third-party lawyers.
7. DATA PROTECTION & PRIVACY
TripShed processes personal data in accordance with applicable data protection laws, including:

Delays or failures outside our control

Indirect or consequential losses
All services are provided on an “as is” and “as available” basis without warranties.
9.1 Force Majeure
TripShed shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, government actions, airline insolvency, system failures, or regulatory changes.
10. TERMINATION
TripShed reserves the right to terminate or suspend services where:

Terms are violated

Fraud or misuse is suspected
-
Continued service is not feasible
Applicable fees may remain payable upon termination.
11. GOVERNING LAW
These Terms shall be governed by applicable laws, with consideration to the customer’s place of residence and mandatory consumer protection regulations.
11.1 Entire Agreement
These Terms constitute the entire agreement between you and TripShed regarding the use of our services and supersede any prior agreements, communications, or understandings.
11.2 No Waiver
Failure by TripShed to enforce any provision of these Terms shall not be considered a waiver of our rights.
12. CHANGES TO TERMS
TripShed reserves the right to update or modify these Terms at any time.
Continued use of services constitutes acceptance of the updated Terms.
